Standard Contract Terms
Scope of Application/Customer Terms and Conditions
These terms and conditions apply to contracts for the participation in seminars, further education and training measures, for the preparation of organizational documents and informational material for hearing acoustic businesses as well as other services rendered by the BI Hörakustik Servicegesellschaft mbH. Customer General Terms do not apply. Anything to the contrary shall only apply if this is explicitly confirmed by BI Hörakustik Servicegesellschaft mbH.
Additional Agreements and Amendments
Additional Agreements require written confirmation by the BI Hörakustik Servicegesellschaft mbH.
Conclusion of contract/Registration
You can register for further education, training measures and seminars online via internet, by e-mail or in writing.
As the number of participants is limited for most events, registrations will be considered in the order in which they are received.
The contract is only concluded upon receipt of a written confirmation by the Hörgeräteakustik Servicegesellschaft mbH.
Right of withdrawal for contracts and distance contracts
You have the right to withdraw from this contract within fourteen days without giving any reasons., as the contract is usually concluded as a distance contract. The withdrawal period is fourteen days from the date of conclusion of the contract. To exercise the right to cancel, you must inform us (BI Hörakustik Servicegesellschaft mbH, Bessemerstr. 3, 23562 Lübeck, telephone: +49 (0)451 5029-0, fax: +49 (0)451 5029-109, E-Mail: widerruf@bi-akustik.de) of your decision to cancel this contract (e.g. regular, fax or e-mail). You can use below sample cancellation form, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your cancellation before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will use the same payment method for repayment, you used for the original transaction, unless explicitly agreed with you otherwise; under no circumstances will there be any fees for a repayment. If you have requested for the services to commence during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time at which you inform us that you exercise the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.
Exclusion of the right of withdrawal
The right of withdrawal does not apply to services in the areas of accommodation for purposes other than residential purposes or the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision of the service.

Changes to the program and exclusion of claims for damages
Cancellation of events: If an event has to be cancelled for unforeseeable reasons, such as the absence of a speaker, insufficient participation due to cancellations or for other organizational reasons, immediate notification will be given. The same applies to changes to seminar schedules, number of lessons, lecturer assignments, fees (only before the start of the course) and dates.
The amount paid for the course will be refunded immediately. Further claims are excluded, except in cases of intentional or grossly negligent behaviours by employees or other vicarious agents of BI Hörakustik Servicegesellschaft mbH.
Copyright
The working documents issued are protected by copyright and may not be reproduced – not even in part – without consent of the BI Hörakustik Servicegesellschaft mbH. Scripts will only be made available to the participants. Image or sound recording of the event by the participant is prohibited. Cell phones must be switched off before the beginning of the event. BI Hörakustik Servicegesellschaft mbH reserves the right to make image and sound recordings of all events and holds all the rights for further use.
Further information for participants
One week prior to the beginning of the seminar, you will receive further information on the location and the time frame of the event.
Prices
Our published prices include the legally applicable VAT. Certificates are usually issued free of charge.
Conditions of Payment
Each event will be billed separately; the payment date will be communicated. The amount must be transferred to BI Hörakustik Servicegesellschaft mbH as a single payment. It is due in full, regardless of whether all seminar units are attended. Verbal agreements regarding monetary matters have no legal validity.
Cancellation costs for binding registration for seminars, further education and advanced training courses
Withdrawal from the contract is possible under the following conditions. Cancellation must be made in writing. We charge the following processing fees in the event of cancellations: Cancellations of a binding registration up to two weeks before the course starts are free of charge. Thereafter, 30% and then 50% of the participation fee will be charged for cancellations up to three days before the start of the course.
If a medical certificate covering the period of the event is provided, cancellation fees will be waived. A registered participate may nominate a substitute. In this case, no additional fees will be charged.
Amendments of bookings: There will be no charge for a one-time amendment of an existing booking, for any other re-bookings, a processing fee of EUR 20,- will be charged.
Rental
For seminars and other events, BI Hörakustik Servicegesellschaft mbH provides single and double rooms as well as training rooms, for participants or event organizers. A separate accommodation/room rental contract will be concluded with the guest/organizer.
Cancellation fee for guest respective training rooms
Both BI Hörakustik Servicegesellschaft mbH and the customer are entitled to cancel the entire room contingent or the room rental in writing up to four weeks before the start of the contract. Cancellations up to two weeks before the start of the contract are subject to a charge of 30% of the rental price. If the booking is cancelled later or rooms are not used, a cancellation fee of 50% of the room price or room rental fee applies.
Notification of defects and damages
Customers must report defects and damage caused by him to BI Hörakustik Servicegesellschaft mbH without further delay.
Claim for Compensation
BI Hörakustik Servicegesellschaft mbH reserves the right to charge the tenant for any material damage resulting from the guest or event room hire.
Severability Clause
Should individual provisions of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions. The parties are obliged to replace the invalid provision with a valid provision that achieves, as far as possible, the economic success intended by the invalid provision.
Place of Fulfillment and Jurisdiction
Place of fulfilment for all claims arising from the contract shall be Lübeck. The contracting parties agree that the district court Lübeck shall be the place of jurisdiction with regard to the subject matter.

Cancellation Policy
Cancellation policy for contracts concluded outside business premises and for distance contracts with the exception of contracts for financial services.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days with giving any reason.
The cancellation period is fourteen days from the day the contract was concluded.
